Abstract
This article addresses the theme "crime of psychological violence against women", seeks to understand whether it is possible to frame the conduct of psychological violence described in article 147-B of the Penal Code to the criminal type of bodily injury described in the same legal diploma practiced by an aggressor. of women, described in Law 11.340/2006 (Maria da Penha Law). The methodology used in the research technique was the bibliographic and documentary with data collection in the courts with qualitative analysis of the data making a dialogue with the researched scholars, using, for this purpose, the method of approach of logical deductive reasoning with research presentation procedure the dissertation in the style of a scientific article. The present study arose from the concerns of the author who works in the health area and is constantly faced with patients suffering from psychosomatic diseases, and is justified to contribute to the elucidation of a topic that is so recent and relevant to society in which the expressive increase in violence against women in Brazil have leveraged. However, it remains evident, through doctrinal and jurisprudential analysis, although practically deserted, that it is necessary to make the reading of the crime of psychological violence against women more assertive in order to make the reading between these two criminal types more harmonious, because, when the criminal type of psychological violence against women of article 147-B of the Penal Code is applied, there is a friction with the criminal type of bodily injury of article 129 of the Penal Code, which makes the new criminal type of article 147- B inapplicable.
