Gender and Education: A Brief Analysis of Educational Policies and Legal Frameworks

The aim of this article is to present a brief analysis of the discussion in the field of gender and sexuality in the light of the Federal Constitution/1988, pointing out the presence of some guidelines from the Escola sem Partido (ESP) movement and the fundamentalist caucus present at the National Congress that act in Brazilian educational legislation. With a qualitative and interpretative approach, the research included a literature review on the discussion on gender in the Federal Constitution/1988 and in the main legal frameworks (LDB, PCNs, 2014 PNE and 2017 BNCC). The bibliographical analysis revealed that the conservative agendas and the School without a Party (ESP) movement are present and influenced the omission of educational policies regarding the debate and construction of gender, sexuality and sexual orientation in schools across the country.
